They\u2019re then requiring those people to sign over those funds to the facility claiming that, because the person is on Medicaid, they get to keep the stimulus payment.<\/p>\n\n\n\n<p>Why?&nbsp; According to the CARES Act, the economic impact payments are a tax credit. Tax law states that tax credits don\u2019t count as \u201cresources\u201d for federal benefits programs, like Medicaid. When Congress calls these payments \u201ctax credits\u201d in the CARES Act, that means the government can\u2019t seize them.<\/p>\n\n\n\n<p>This means that nursing homes and assisted living facilities can\u2019t take that money from their residents just because they\u2019re on Medicaid.<\/p>\n\n\n\n<p>If you&#8217;ve noticed that your stimulus was taken by your nursing home, contact <a href=\"https:\/\/www.naag.org\/naag\/attorneys-general\/whos-my-ag.php\">your state attorney general<\/a> and ask them to help you get it back.<\/p>\n\n\n\n<p>If this has already happened to you or a loved one, contact your <a href=\"https:\/\/www.naag.org\/naag\/attorneys-general\/whos-my-ag.php\">state attorney general\u2019s office<\/a> first.&nbsp; Then contact the FTC: <a href=\"http:\/\/www.ftc.gov\/complaint\">ftc.gov\/complaint<\/a>. If a loved one lives in a nursing facility and you\u2019re not sure what happened to their payment, talk with them immediately. You might also consider having a talk with the facility\u2019s management to make sure they know which side of the law to be on.<\/p>\n\n\n\n<p>Need more information to back-up your position?&nbsp; You can go <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/26\/6409\">here<\/a> to get the federal tax law that says refunds aren\u2019t considered a \u201cresource\u201d in federal benefits programs.
